The Subdivision and Development Servicing Bylaw (SDS Bylaw) regulates the subdivision and development of land, including the administrative and technical standards for initiating and completing developments. The existing SDS Bylaw was written and adopted by council in 1998. Since that time, the City has updated plans and bylaws such as the Official Community Plan, and Active Transportation Master Plan and Asset Management Policy. As a result of these updates and the evolution of industry best practices, changes to the SDS Bylaw are required to better meet the needs of the City and residents today and into the future.
The objectives for the bylaw update are to:
Align the SDS Bylaw with updated City plans, bylaws and policies such as the Official Community Plan, Active Transportation Master Plan, and Asset Management Policy
Incorporating the Master Municipal Construction Document (MMCD) into the SDS Bylaw to reflect design and development best practices
Project timeline
The City of Fernie (City) has engaged ISL Engineering to update the SDS Bylaw and through the spring and summer has been engaging with developers, City staff, the public and those interested in land development, to gain insight and understanding of their experience using the current SDS Bylaw.
During the second phase of engagement the project team shared how feedback from the first round of engagement was used to refine the bylaw and the team is currently preparing and finalizing the draft bylaw for City council review and approval in Spring 2024.

As part of the SDS Bylaw update process, the City will be engaging with developers, City staff, the public and those interested in developing properties to gain insight and understanding of their experience using the SDS Bylaw. During this first phase of engagement, we are gathering information to help inform the SDS Bylaw update.

1st Reading Occurred on April 23.
We are returning to council for 2 and 3rd Readings on June 11.
If 2nd and 3rd readings go through, adoption is scheduled on June 25.
Bylaw if adopted would come into effect on Sept. 1, 2024.
